This website (henceforth “website”) is provided by passify GmbH (henceforth “us” or “we”).

A. Handling of personal data

The following provides information about how personal data is handled when using this website. Where not described otherwise in the following sections, the legal basis for handling your personal data arises from the necessity of handling it for the purpose of providing the functionalities requested by you on this website (Section 6(1)(b) of the General Data Protection Regulation (GDPR)).

B. Use of the website

1. Calling up the website

When you call up our website, your browser automatically transfers certain data to our web server in order to provide you with the information you have called up. In order to make your visit to our website possible, the following data is collected, briefly stored and used:

  • IP address
  • Date and time of the request,
  • time zone difference from
  • Greenwich Mean Time (GMT)
  • Content of the request (specific page)
  • Operating system and its access status / HTTP status code
  • Data volume transferred
  • Website from which the request comes
  • Browser, language and version of the browser software.

To safeguard our legitimate interests, we also store this data for a limited time to allow derivation of personal data in the case of unauthorised access or attempted access to local servers (Section 6 (1) (f) GDPR).

2. Use of cookies

a) What cookies are

We use cookies on this website. Cookies are small text files that are stored in your device memory via your browser. Cookies store certain information (e.g. your preferred language or site settings), which can be returned to us by your browser when you visit the website again (depending on the life of the cookies).

b) How you can limit the use of cookies

You can configure or entirely deactivate the use of cookies in your browser settings at any time. However, this may lead to a limitation in the functionality or user-friendliness of our website.

3. External services and content on our website

We integrate external services and content into our website. If you use such a service or if third party content is displayed to you, communication data between you and the respective provider is automatically exchanged. It may also be the case that the provider of the respective services or content processes your data for their own purposes. We have configured services or content from providers that are known to use data for their own purposes to the best of our knowledge and belief in such a way that there is no communication for purposes other than for display of the content or services on our website or that communication only takes place if you actively decide to use the service. Since we have no influence on the data collected by third parties and how they process it, we are unable to give definitive information about the purpose and scope of the processing of your data. Further information about the purpose and scope of the collection and processing of your data can therefore be found in the data protection notice of the respective provider of the services and content integrated by us. 4. Google Analytics

This website uses Google Analytics, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). Google Analytics uses cookies that enable an analysis of your use of the website. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity, and to provide other services related to website use and internet use to the website operator. You can prevent the storage of cookies by selecting the appropriate settings in your browser software. Please note that if you completely disable the storage of cookies, you may not be able to use all the functions of this website to their full extent. Google Analytics is used on this website with IP anonymization. This means that your IP address is shortened immediately so that it can no longer be directly linked to a specific person. All collected data that could potentially allow conclusions to be drawn about your identity is anonymized and deleted.
We use Google Analytics to analyze the use of our website so that we can regularly improve the user experience based on the insights gained. The legal basis for processing your data is the consent you have given via the cookie consent tool (Art. 6 para. 1 sentence 1 lit. a GDPR). 5. Third-country transfer

As part of the processing of your personal data, it may occur that we transfer your personal data to trusted service providers in third countries. Third countries are countries outside the European Union (EU) or the European Economic Area (EEA). We only work with service providers that provide appropriate safeguards for the security of your personal data and can guarantee that your personal data is processed in accordance with the strict European data protection standards. If we transfer personal data to third countries, this is done on the basis of an adequacy decision by the European Commission or on the basis of so-called EU standard contractual clauses, as well as, where applicable, additional appropriate safeguards. The EU standard data protection clauses are freely available on the website of the European Commission.
 
Despite these contractual and any additional technical and organizational measures, it is possible that the level of data protection in the third country does not correspond to that of the European Union. The legal basis for such international data transfers is your consent pursuant to Art. 49 para. 1 sentence 1 lit. a GDPR, which you provide via the consent in the cookie banner (or in other forms, registrations, etc.). There is in particular the risk, especially in the case of data transfers to the USA, that your personal data may be processed by authorities for control and surveillance purposes, possibly without sufficient legal remedies, without us as the data exporter or you as the data subject becoming aware of this.
 

6. Google Tag Manager

This website uses Google Tag Manager. This service allows website tags to be managed via an interface. Google Tag Manager itself does not set cookies, but merely implements tags and does not collect any personal data. The service triggers other tags, which may in turn collect data. However, Google Tag Manager does not access this data. If deactivation has been carried out at the domain or cookie level, this remains in effect for all tracking tags implemented via Google Tag Manager. Google Tag Manager is used to deliver cookies but processes only technical information and is therefore not subject to consent requirements under the TDDDG. The legal basis for the use of Google Tag Manager is therefore Art. 6 para. 1 lit. f GDPR. Our legitimate interest lies in the uniform and proper integration of cookies across different end devices.
 

7. Transfer of data for processing on our behalf

We use specialised service providers to process some of your data. We carefully select and regularly monitor our service providers. They process personal data via order processing exclusively on our behalf and strictly in accordance with our instructions on the basis of corresponding agreements.
Data will only be processed outside the EU/the European Economic Area where an adequate level of data privacy is guaranteed.

8. Information about your rights

You have the following rights based on the applicable data protection laws:

  • Right to information about the data we have stored about you
  • Right to rectification, deletion or limitation of the processing of your personal data
  • Right to object to processing that serves our legitimate interests, a public interest or profiling, unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or the processing serves the enforcement, exercise or defence of legal claims
  • Right to data transferability
  • Right to complain to a supervisory authority
